Qbit’s phishing simulation, security awareness training, and related cybersecurity platform
1) Acceptance of These Terms
By creating an account, accessing, or using the Service, you agree to these Terms & Conditions If you do not agree, do not use the Service.
2) Eligibility and Authority
You represent that:
- Your Organization is legally able to enter into a binding agreement;
3) Definitions
- Authorized Users: Users you permit to access your Organization’s account (Campaign Managers, Students).
- Target Users: Individuals who receive simulation messages (e.g., employees) as part of campaigns.
- Campaign: A phishing simulation or training activity configured through the Service.
- Customer Data: Data you upload or generate through use of the Service (including campaign configuration, target lists, metrics, and results).
4) Scope and Purpose of the Service
The Service is intended solely for legitimate cybersecurity purposes, including security awareness training, phishing simulation exercises, and measuring and improving an Organization’s security posture. You must ensure you have the necessary legal rights and permissions to run campaigns involving any Target Users.
5) Authorized Use (You Must)
- Use the Service only for lawful purposes and authorized security testing/training
- Maintain accurate account and Organization information
- Secure your credentials and restrict access to Authorized Users only
- Follow all applicable workplace policies, internal approvals, and data protection requirements
6) Prohibited Use (You Must Not)
- Target any person or organization without proper authorization
- Bypass or attempt to bypass authentication, access controls, or logging
- Interfere with Service operation, probe infrastructure, or perform denial-of-service behavior
- Resell, sublicense, or provide the Service as a standalone bureau/phishing service without Qbit’s written permission
Qbit may suspend or terminate access if we reasonably suspect prohibited or abusive use.
7) Customer Responsibilities (Compliance and Approvals)
- Obtaining required internal approvals (management, HR, legal, compliance)
- Ensuring campaigns comply with applicable laws and employment rules
- Communicating notices/consent to Target Users where required
- Ensuring target lists are accurate and lawfully obtained
8) Account Security
- You are responsible for all activities under your account and your Authorized Users’ actions.
- Notify Qbit immediately at
qbitcybersolutions@gmail.com if you suspect unauthorized access.
- Qbit may require password resets or other security steps if risk is detected.
9) Data, Privacy, and Confidentiality
9.1 Customer Data Ownership
You retain ownership of your Customer Data. Qbit does not claim ownership over Customer Data.
9.2 How Qbit Uses Customer Data
Qbit processes Customer Data to provide and maintain the Service, troubleshoot issues and provide support, maintain security/auditability/platform integrity, and improve Service performance and reliability.
9.3 Confidentiality
Both parties agree to protect non-public information shared in connection with the Service. Customer Data and campaign results are treated as confidential.
10) Service Availability and Maintenance
Qbit aims for reliable availability, but the Service may be unavailable due to maintenance, upgrades, third-party outages, or network issues. Email/SMS deliverability is not guaranteed because delivery depends on external systems.
11) Third-Party Services
The Service may integrate with third-party services. Qbit is not responsible for outages, errors, or policy changes from third parties beyond our reasonable control.
12) Subscription, Plans, and Billing
Plans, features, and limits are defined by the plan you select and/or your invoice/contract. Fees are payable in advance unless stated otherwise. If payment is overdue or a subscription expires, Qbit may restrict access to paid features and/or suspend the account until payment is resolved.
13) Renewals, Upgrades
Renewals and changes may take effect immediately or at the end of the current billing period depending on your plan settings and payment method. If you upgrade or renew, additional fees may apply as shown during checkout.
14) Governing Law, Jurisdiction, and Refund Clarification (Final Clause)
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Federal Democratic Republic of Ethiopia.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Addis Ababa, Ethiopia, unless otherwise required by applicable law.
Refund Policy Clarification:
All subscription fees are non-refundable once the Service has been activated or accessed, except where required by applicable law.
Qbit may, at its sole discretion, consider exceptional refund requests on a case-by-case basis, particularly where the Service has not been used.
15) Intellectual Property
Qbit owns the Service, including its software, design, trademarks, and underlying technology. Qbit grants you a limited, non-exclusive, non-transferable right to use the Service for your internal authorized cybersecurity training/testing during your subscription term. You must not copy, modify, reverse engineer, or create derivative works of the Service except to the extent permitted by law.
16) Feedback
If you provide suggestions or feedback, you grant Qbit permission to use it to improve the Service without obligation to you.
17) Suspension and Termination
17.1 By Customer
You may stop using the Service at any time. If you cancel a paid subscription, access may continue until the end of the current paid term unless otherwise stated.
17.2 By Qbit
Qbit may suspend or terminate access if you violate these Terms, use is suspected to be unlawful/harmful/abusive, payment obligations are not met, or continued access poses security or legal risk.
18) Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. Qbit does not guarantee that simulations will achieve specific results or ensure compliance outcomes.
19) Limitation of Liability
To the maximum extent permitted by law, Qbit is not liable for indirect, incidental, special, consequential, or punitive damages. Qbit’s total liability for any claim related to the Service will not exceed the amount you paid to Qbit for the Service during the [last 3 months / last 12 months — choose one] before the event giving rise to the claim.
20) Indemnification
You agree to indemnify and hold harmless Qbit Cyber Solutions PLC from claims, damages, liabilities, and expenses arising from your unauthorized/unlawful use of the Service, campaigns conducted without proper authorization/consent, and your violation of laws/regulations/third-party rights.
21) Changes to These Terms
Qbit may update these Terms. If changes are material, Qbit will provide notice through the Service or via email. Continued use after the effective date means you accept the updated Terms.
